All purchase orders on the Site are subject to these Terms and Conditions of Sale. These are likely to undertake changes and updates, the conditions applicable to the delivery of a product by a customer are those in effect at the date of the order. These terms and conditions shall be construed according to, and governed by French Law; the parties moreover agree to submit to the exclusive jurisdiction of the French courts in any dispute or difference of any kind which may arise concerning the contract.

All products remain the property of LATY until full payment has been made. All attempts to deceive will be reported. We reserve the right to correct any mistake or error printed on this site. Due to the digital format of photographs we cannot grant that the pictures reflect the exact nature of the real products.

Acceptance of Terms.

By using “the Website”, you agree to the terms of use, and you consent to the collection, use and disclosure of information as described in these terms of use and our privacy policy. If you do not agree to these terms of use and the terms and conditions of our privacy policy, you must exit the site immediately and discontinue any use of the site. LATY can change these terms at any time by posting updated terms of use on the site. If any changes are unacceptable to you, you shall cease using the site, otherwise you will be deemed to have accepted the change. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with LATY.

1 – Customer

The customer declares to be an adult individual and legally capable. The customer shall, at its first order on the Website, open an account and fill out an order form containing certain mandatory fields so that its products purchase order can be taken into account by LATY. You are solely responsible for (i) maintaining the security and confidentiality of your account and your account password; (ii) restricting access to your computer and your account; and (iii) keeping your email address listed on your account current. You are solely responsible and liable for all activities, including, without limitation, all purchases of products and services through the use of the Website that occur under your account or your account password.

The information provided to LATY across the opening of the account or at each of its orders must be complete, accurate and up to date. LATY may, if necessary, ask the customer to confirm – by any means – this information and identity. On the Website, LATY collects personal data. These data are required to process the order and may be provided in whole or in part to LATY providers involved in the execution of the order. You acknowledge and agree that LATY may access, preserve, and disclose your account information, all Submissions, all communications to and from you, all information relating to your use of the Site, and all information relating to the use of the Site under your account or account password if LATY is required to do so by law or legal process or if LATY determines, in its sole discretion, that such action is necessary to protect the rights of LATY, third parties, and other users of the Site or for purposes of responding to your request for customer service. LATY’s right to disclose any such information shall govern over any terms of our Privacy Policy.

The customer is informed that these personal data are collected by an organization responsible for analysis, control and fight against fraud credit card. The site has been declared to the CNIL (Commission Nationale Informatique et Liberties) under number 1967124v0 dated 8th of June of 2016. The personal data recorded on this site will be stored and used in accordance with the law n ° 78-17 of 6th of January of 1978 relating to data, files and freedoms. 2 – Products

The products offered for sale are as described on the website. LATY take care and great accuracy in the description and presentation of their products, within the limits of technology and in accordance to the best industry standards. If the products ordered are no longer available, LATY will inform the customer by e-mail as soon as possible and refund the purchase price that may have been invoiced on the credit card. All product sales from the Site are governed by any terms of sale that may be posted on the Site. You should refer to our contact page to learn more about applicable product warranties, our return policy, and shipping terms. By ordering and/or accepting delivery of the products, you agree to be bound by these terms of sale. The terms of sale are subject to change without prior notice at any time, in LATY’s sole discretion so you should review the terms of sale each time you make a purchase.

03 – Orders


Taking orders on the Website is subject to compliance with the procedure established by LATY materialized by a succession of screen pages indicating the steps the customer must follow to validate his/her order. The customer will have the option before final validation of the order, to check the details thereof and the total price, and correct any errors before confirming it to express its acceptance.

Checking the order:

LATY will be entitled to refuse any order placed by a customer with whom there is a dispute over payment of a previous order and all orders that do not comply with these conditions of sale. In this case, LATY will inform the customer by phone or email. In the event the customer does not proceed to the correction of incorrect information, LATY reserves the right not to process the order.

Confirmation of the order:

Once the customer validates the order, LATY acknowledges receipt by e-mail to the address provided by the customer. To this end, the customer formally accepts the use of email for confirmation LATY content of the order. This confirmation email contains all the information provided by the customer and the price and terms of payment with indication, where appropriate, of the reservations or difficulties, which may arise from the order. The payment of these fees may be required at the entrance of the ordered products in the territory of delivery. It is the sole responsibility of the customers, which they accept.

For all practical purposes, the information on the additional charges in case of request for delivery outside of the European Union territory will obviously be specified on the Website for any client indicating a delivery address outside the territory of the European Union. The clients accept to take charge of all fees linked to the importation of a product ordered on the Website. The refusal of payment by the customer of customs charges causes the cancellation of the order. Payment of the total price of the products and shipping is by credit card or PayPal. In order to fight against fraudulent payments, a visual check of means of payment may be asked by the customer service of LATY before checking your products.

Payments by check are not accepted. In the event that for any reason whatsoever (opposition, refusal of issuing center …), the transfer of money owed by the customer proves impossible, the order will not be saved. LATY is entitled to cancel any order if the client’s IP address is domiciled in a country different from the delivery address. In the event of unavailability of a product after placing the order, the Customer will be notified by email or by phone. It has the option to request repayment of the sums or exchange the product. Refunds will be made within 30 days.

In exceptional circumstances, if the item ordered is not available, the customer can proceed for an exchange or be fully reimbursed of the total sum paid in no later than 30 days.

Discounts and promotions

All discounts and promotions offered on the website shall only apply within the specific period allocated and detailed in the offer and within available stock. Promotions and discounts can in no way be linked to nor provide any type of reimbursement or payment to customers.

Discounts and promotions are reserved for concerned clients. No transfers of any kind to third parties are permitted.

The amount of a promotion or rate of a discount shall be deducted from the price on the order including VAT. This shall not apply to any handling or shipping fees applicable to orders, which shall remain at the customer’s charge.

Unless indicated otherwise, special offers, promotions and discounts cannot be cumulated.

5 – Delivery

LATY make their best efforts to ensure that the order is shipped within an average of one (1) to five (5) working days from the day following the validation by the buyer of his order. Following the shipment LATY, the delivery time will be three (3) to twenty (20) days for shipments by Colissimo, DHL or other courier. Delivery is made to the delivery address specified by the customer, provided that it must be the home address of the customer or any other person of his choice. Delivery cannot be made to either hotels or PO boxes.

The Customer will have the opportunity to follow its package through tracking number which will be sent by email when sending the order. If delivery is requested outside of the European Union, LATY will accept to deliver the product, but the customer will have to bear all possible duties, taxes and other official charges as well as costs of accomplishment customs formalities payable upon import of products in the country where delivery is requested.

So that these deadlines are met, the customer must ensure to provide accurate and complete information regarding the delivery address (such as, for example: street number, building, stairs, access codes , names and / or numbers intercom, etc.).. Inaccurate information may result in additional time for delivery or forwarding.

Outside the territory of the European Union, it is reminded that the clients accepts that the delivery may be delayed until the formalities and customs fees have not been paid by the client. Refusal of payment by the customer of customs charges causes the cancellation of the order. The client is solely responsible for the above. LATY will not proceed with refund.

Once the order is confirmed, it will not be possible for the Customer to change the delivery address. The total shipping of the ordered products will be shown on the website to the customer before he accepts the order and will be mentioned again in the confirmation email sent by LATY as well as in the delivery notes.

The delivery fees will be confirmed to the customer before payment. LATY is not liable for any delivery delay.

6 – The right of withdrawal

The customer has a right of withdrawal he can exercise without having to give any reasons, within fourteen (14) days from the receipt of the products ordered. To simplify the exercise of the right of withdrawal, LATY ask customers to contact customer service by e-mail: hello [@] to inform a product return. Products must be returned in perfect condition, complete, accompanied by a copy of the documents attached to the order and back in their original packaging, over which must be added another packaging fully wrapping the product; they must not bear any trace of using and have all of their accessories. Products returned incomplete, damaged, soiled or damaged by the customer will not be refunded. The return costs and risks are supported by the customer. It is therefore advisable to keep proof of return, which implies that the products are returned with parcel tracking, or by any other means giving a certain date. It is only after checking that those conditions are satisfied that LATY will refund the amount matching the returned items, except for the initial shipping fees. Reimbursement of the full invoice price (excluding shipping charges) will be returned by crediting the credit card in a lapse of thirty days following the date on which the right of withdrawal has been exercised.

7 – Warranties

Compliance :

The client is asked to ensure that the product delivered matches its order. In case of an anomaly at the delivery, if the products are non conform or have defects in nature (eg: wrong color), the customer must in the shortest time or the same day of receiving the order inform LATY at the following address: hello [@] For non-conforming products delivered by LATY at delivery addresses outside the territory of the European Union, the customer undertakes to notify-by any means-customs services it is a return of non-conforming products. If possible exchange of the returned product, a refund of the total price charged (price of non-compliant products and shipping) and return costs (to a maximum of 20 €) will be made by credit card bank no later than thirty (30) days following receipt by the LATY returned products.

Any claim done more than 3 days after receiving the product will not be accepted.

The absence of claim or the lack of information by the customer in the 3 days term means that the articles delivered are satisfying and may not be the case of further liabilities.

Legal guarantees :

Notwithstanding the terms of any specific warranty to the customer with the product delivered, LATY products sold on the Website are subject to the following statutory warranties: Article L.211-4 of the Consumer Code: “The seller must deliver goods in conformity with the contract and liable for defects of conformity existing at the time of delivery. It also addresses the lack of conformity resulting from the packaging, instructions for assembly or installation when it was put to him by the contract or carried out under its responsibility.” Article L.211-5 of the Consumer Code: “To comply with the contract, the property must:

1. Be suitable for the purpose usually associated with such a product and, where applicable: – Correspond to the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model; – Have the qualities that a buyer might reasonably expect based on public statements made by the seller, the producer or his representative, particularly in advertising or labeling;

2.
